Your obligations & rights
- You are entitled to use all the features of the Elegy platform that are available on the plan you paid for.
- You hold the copyright to all content contained in a tribute you create. When you “publish” a tribute, you give permission that all of the content may be published on the Elegy website indefinitely.
- The copyright of any content in a comment belongs to the person who posted that comment. When you post a comment, you give permission that all content of a comment may be published on the Elegy website indefinitely. If you are posting a comment, you understand that the owner of the tribute on which you are posting your comment may, for any reason, decide to disallow your comment from being published.
- You agree to include nothing in a tribute or comment that you know to be false, that libels or defames another individual, that is abusive, hostile, excessively violent or sexual, or otherwise inappropriate for this platform.
- You agree that you will not use in a tribute or comment any text, images, videos, audio, or any other creative material that is held under copyright by someone else, unless you have the copyright holder’s written permission.
- You may “unpublish” any of the tributes or comments in your account, at your discretion, effectively revoking your permission for Elegy to show that content publicly. You may republish it later at no additional fee, if you like.
- If you “delete” a comment or tribute it will be removed permanently from the database and you will not be able to recover it.
- If you pay for a tribute and then do not publish it or do not invite someone to be the trustee of the tribute (in the case of self-written obituaries, for instance), you may be entitled to a refund unless more than 90 days has passed from the time you paid. If you receive a refund for an unpublished tribute, all text, images, videos, and any other content associated with that tribute will be deleted and will not be recoverable. Your overarching user account will remain active, however, unless you ask for it to be deleted as well.
- You understand that once a tribute has been published, there are no refunds, except in very unusual circumstances. Please contact us if you believe you have a legitimate reason for requesting a refund.
- If you post a comment to a tribute, you agree that a user account be automatically created for you at Elegy. This may not be obvious, but it is necessary to simplify the process of posting a comment.
- You may delete your user account at any time. If you delete your user account any tributes or comments associated with that account also will be deleted.
- You understand that if you opt for a “free trial” of Elegy, and then decide not to continue and do not pay by the end of the trial period, your user account and all data will be permanently deleted after a specified grace period. This will be communicated to you when you sign up for the trial, and additionally several times by email after your trial is over. After the grace period concludes and you have let your trial lapse any tributes you had created during the trial period will not be recoverable.
Our obligations & rights
- Elegy reserves the right to remove any content that we deem harmful, inappropriate, false, or libelous, or that we learn is copyrighted and used without permission, or that otherwise violate these terms of use.
- Elegy reserves the right to suspend or delete user accounts at our discretion for non-payment or for not conforming to these terms of use.
- Elegy in no way endorses or vouches for links to third-party websites that are included in any tribute or comment, including links in the “Donations” section of a tribute, where tribute owners can suggest charitable contributions in memory of the subject of the tribute. Please use your own discretion when choosing to follow those links or donate to the organization that is linked to.
In case of business changes
- If Elegy is ever sold or acquired by another company, you will be informed, and receive notice of any changes to these terms of use or to our privacy policy.
- If Elegy should ever close down, we will inform you and send a digital copy of any tributes you have published.
These terms of use may be updated periodically.
